Fiberglass Pools South Brisbane Terms and Conditions
1. Introduction
Welcome to Fiberglass Pools South Brisbane (“we”, “us”, “our”). By engaging our services or using our website, you agree to these Terms and Conditions and warrant that you are over 18 years of age (or have appropriate consent) and have capacity to enter into and comply with these Terms.

3. Australian Consumer Law (ACL)
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the ACL.
4. Product Information
While we aim for accuracy, dimensions, specifications, colours, finishes, availability, and lead times may vary. Please verify critical details before purchase and installation
5. Quotations, Pricing, and Payments
5.1 Quotes are valid for the period stated and may be subject to site conditions, approvals, or supplier price changes.
5.2 Progress payments are due upon reaching agreed milestones as set out in your contract or invoice.
5.3 Late payments may incur reasonable administration and interest charges.
6. Site Conditions, Approvals, and Variations
6.1 You are responsible for providing accurate site information and reasonable site access.
6.2 Council/authority approvals (where required) are your responsibility unless otherwise agreed in writing.
6.3 Unforeseen conditions or client-requested changes may require variations, which will be priced and approved in writing before we proceed.
7. Delivery, Risk, and Title
7.1 Risk in goods passes on delivery to site or on installation (as applicable).
7.2 Title passes on receipt of full payment.
8. Installation and Client Responsibilities
8.1 We will perform installation with due care and skill and in accordance with applicable standards.
8.2 You must follow all pre-installation and post-installation instructions, including curing times, water chemistry, and maintenance schedules, to avoid damage and to preserve warranty coverage.
9. Warranties and Claims Process
9.1 Shell warranty (PMA). Claims relating to the structural shell must be made under the PMA manufacturer warranty. We will reasonably assist you to lodge a claim with PMA, but assessment and remedy are determined by PMA under its warranty terms.
9.2 Workmanship warranty (us). Claims relating to our installation workmanship must be notified to us in writing within the applicable warranty period; we will assess and rectify in accordance with our warranty terms.
9.3 Proof of purchase, site access, and compliance with care/maintenance instructions may be required to process any claim.
9.4 These warranties apply in addition to your ACL rights.
10. Intellectual Property
All trademarks, logos, and brand names are owned by their respective owners or used under licence. Unauthorised use is prohibited.
11. Privacy
Our Privacy Policy explains how we collect, use, and safeguard personal information. By using our services, you consent to those practices.
12. Liability
12.1 To the maximum extent permitted by law and subject to clause 3, our liability for any breach of non-excludable guarantees is limited, at our option, to re-supply of the services or payment of the cost of having the services supplied again, or the repair/replacement of goods or payment of the cost of repair/replacement.
12.2 We are not liable for indirect or consequential loss, loss of profit, or loss of opportunity, except where prohibited by law.
12.3 We are not responsible for a manufacturer’s refusal or delay in honouring its own warranty, except to the extent required by the ACL.
13. Indemnity
You agree to indemnify us against liabilities, claims, and expenses arising from your breach of these Terms or misuse of the goods/services, except to the extent caused by our negligence or breach of the ACL.
14. Modifications to Terms
We may update these Terms from time to time. Continued use of our services after any update constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia. Disputes are subject to the courts of Brisbane, Queensland.
